Skifta Privacy Policy
This
is the SkiftaTM Privacy Policy ("Policy").
This Policy applies to your use of our web site www.skifta.com (the
"Site") and your use of the Skifta service which, among other things,
enables you to access your digital media from multiple physical locations or
media players (the "Service"). Using the Service requires that you
install our software on your computer and/or mobile device (the
"Software") and we call each computer and/or mobile device on which
you install the Software a "Skifta Place." The Site, Service, and
Software are being provided by Qualcomm Atheros, Inc., a company headquartered
in California, U.S.A. ("we", "us" or "our"). When
visiting our Site or using our Service or Software you agree to this Policy.
US Safe Harbor Registration.
Skifta
complies with the U.S. – E.U. Safe Harbor framework and the U.S. - Swiss
Safe Harbor framework as set forth by the U.S. Department of Commerce regarding
the collection, use, and retention of personal data from European Union member
countries and Switzerland. Skifta has certified that it adheres to the Safe
Harbor Privacy Principles of notice, choice, onward transfer, security, data
integrity, access, and enforcement. To learn more about the Safe Harbor

Data We Collect.
Our Site. While you visit our Site, our servers
record the information your browser automatically sends to view any web site
such as your IP address, browser type, operating system, time of your request,
and other information about how you navigate our web site. We use this
information to ensure the technical functioning of the Site and improve our
Site and our products and services.
Registration. We collect information when you
register for the Service such as your preferred username, password, and email address.
We will use this information to establish your account with the Service.
Installation of the Software & Use of the Service. When you install the
Software and use the Service, we will collect information regarding the devices
you have connected to your network such as the names and types of devices you
have, the media manager you use (e.g., Windows Media Player), and we will
collect information about your digital media such as title, artist, rating,
genre, file name, etc. We will also collect information about the installation
of our Software such as the data and time, the version, your operating system,
and IP address. In addition, we will also collect information about how you use
the Service, such as the frequency and duration of use, and the features of the
Service that you use such as you accessing your media on other devices or
networks.
Information You Submit. If you voluntarily
submit information to us - for example, if you participate in a survey, provide
us feedback, make a purchase through our Site or Service, or respond to our
request for information - we will collect the information you submit. In each
such instance, you will know what data we collect, because you actively submit
it. We will use the data you voluntarily submit to us for the purposes we
describe in this Policy, as well as any purposes that we describe to you when
we collect such information.
Cookies. If you register on our Site, we will
place a small data file on your computer (called a "cookie") when you
login to identify you as you navigate around our Site and to enhance and
personalize your experience. In addition we may use cookies to help us display
relevant advertising to you when you visit our Site. These cookies also help us
measure the performance of our advertising campaigns. You are free to decline
cookies, but by doing so, you may not be able to use certain features on the
Site or take full advantage of all of our offerings. Check the "Help"

Cross-Border Transfer.
The
information we collect is stored and processed on servers in various locations
around the world. By using the Service you consent to the transfer of the
information described in this Policy to locations that may be outside of the
country in which you live, and such places may be in the United States, within
one or more European countries, and/or in one or more countries within Asia.
Use of Data.
In
addition to the other uses of your information described in this Policy, we may
use and process the data we collect to:

and improve the Service, including providing personalized recommendations
for content, products, or services;
- Respond
to requests that you may send us such as your request for information, or
your request to subscribe to a service we offer;
- Administer,
protect and improve our Site, our Service, and our systems;

our rights and the rights of our users;

- Any
other use we describe at the point where we collect the data.
Please
note, when you make one of your digital media sources accessible to another
Skifta Place (which may be your friend's physical location if you so choose),
you are making all of the digital media from that media source available to
that other Skifta Place. If there is digital media available on that media
source that you do not want disclosed to the other Skifta Place, you should
remove, delete, or otherwise remove or disable that digital media from that
media source.
To
the extent permitted by applicable law, we reserve the right to combine the
various types of data that we collect and to combine the data that we collect
with data that we obtain from third parties or other sources. We may use the
combined data for any of the purposes described in this Policy.
Finally,
we may de-identify, aggregate or otherwise make the data we collect anonymous
and use that information for our business purposes. This Policy does not apply
to data once it has been de-identified or made anonymous.
Data Sharing.
We
do not share your personally identifiable information with others, except as
follows: We freely share your information within the Qualcomm group of
companies, except for personal data transferred from the European Economic Area
and Switzerland, which we only share with our subsidiaries that process data on
our behalf or if we transfer the personal data using other legal mechanisms
(e.g., consent). We may share your information with third parties who process
the data only on our behalf for the purposes set forth in this Policy. We may
also share your information as required by law or in the interest of protecting
or exercising our or others' legal rights, e.g., without limitation, in
connection with requests from law enforcement officials and in connection with
court proceedings. We may share or transfer your information in connection with
a prospective or actual sale, merger, transfer or other reorganization of all
or parts of our business. Finally, we may also share your personal information
where you have granted us permission and we reserve the right to fully use and
disclose any information that is not in personally identifiable form.
Forum and Blog.
Our
Site may provide a forum, blog, or other interactive feature that allows you to
disclose information directly to other users. Your participation in such
interactive features is completely voluntary and we assume no obligations or
responsibility with respect to the information you provide or share through
such interactive features. To participate in these interactive features, we may
require you to register with us and provide certain information such as your
name, email address, location, phone number, and desired display name (which
may be viewable by other users of the interactive features). We or our service
providers may use the information you provide during the registration process
for analytical and development purposes (such as to make product or service
enhancements) and to enable you to use the interactive features and to manage
your account. You may also personalize our interactive features by voluntarily
providing additional information such as your location, instant message contact
information, web site address, occupation, and other information. Our
interactive features may also allow you to upload an avatar or other graphical
representation of yourself. If you voluntarily provide such additional
information, it may be viewable by other users of the interactive features - so
you should not provide information you do not want other users to see.
Links.
The
Service and/or Site may provide links to third party web sites that we do not
own or operate. Such links may include, but are not limited to, advertising,
sponsorships, promotions, recommendations, or links to other third party
content ("Third Party Sites"). The Third Party Sites and the data
that they collect and that you provide them are governed by the privacy
policies of such Third Party Sites and not this Policy. We are not responsible
for the content of, or activities conducted by, Third Party Sites and our
provision of links to Third Party Sites is not an endorsement by us of the
Third Party Sites or any products or services they may offer.
Opt-Out.
If
you do not want us to collect, use, and share the information we describe in
this Policy, please discontinue your use of the Site and Service and uninstall
the Software using the standard means for removing software for your computer
and/or mobile device. In connection with promotions, surveys, or other
projects, we may ask you whether you object to our specified data use or
sharing. If you opt-out under such circumstances, we will respect your
decision. Please note that our affiliates and other data recipients have their
own data privacy policies, which may differ from ours and you would have to contact
them separately with respect to opt-out requests.
Access.
If
personal information you have submitted through the Site, Service or Software
is no longer accurate, current, or complete, please update it by using the
profile feature provided on our Site when you log-in. If you would like to
access the data that we have collected about you, please send an email to
support@skifta.com. Upon request we will provide you a copy of your information
within in a reasonable time and we will correct or delete it upon your request.
Notwithstanding the foregoing, there may be circumstances where we are legally
required to retain the information we collect about you (for example, in
connection with court proceedings) and despite your request for us to delete
your information, we will retain what we are legally required to keep. We also
reserve the right to use previously obtained information to verify your
identity or take other actions that we believe are appropriate.
Security.
Transmissions
over the Internet are never 100% secure or error-free. However, we take
reasonable steps to protect your personal information from loss, misuse, and
unauthorized access, disclosure, alteration, and destruction. It is your
responsibility to safeguard your username and password for access to the
Service and to notify us at support@skifta.com if you ever suspect that your
username or password has been compromised. You are solely responsible for any
unauthorized use of your account with the Service conducted via your username
and password.
Children's Privacy.
The
Site and the Service are intended for people that are at least 13 years old. We
do not intentionally or knowingly collect personally-identifiable information
from children under the age of 13 and individuals under the age of 13 are
prohibited from registering for the Service, prohibited from downloading or
installing the Software, and prohibited from submitting any personal
information on our Site or through our Service.
Safe Harbor Dispute Resolution
We
participate in the EU and Swiss Safe Harbor Privacy Framework as set forth by
the United States Department of Commerce. As part of our participation in the Safe Harbor,
we have agreed to TRUSTe dispute resolution for disputes relating to our
compliance with the Safe Harbor Privacy Framework. If you have any complaints
regarding our compliance with the Safe Harbor you should first contact us (as
provided below). If contacting us does not resolve your complaint, you may
raise your complaint with TRUSTe by Internet here, fax to
415-520-3420, or mail to TRUSTe Safe Harbor Compliance Dept. (click for mailing address). If you are faxing or mailing TRUSTe to lodge a complaint, you must
include the following information: the name of company, the alleged privacy
violation, your contact information, and whether you would like the particulars
of your complaint shared with the company. For information about TRUSTe or the
operation of TRUSTe’s dispute resolution process, click here or request
this information from TRUSTe at any of the addresses listed above. The TRUSTe
dispute resolution process shall be conducted in English. For human resources
data we have agreed to cooperate with data Protection Authorities.
Changes.
We
may change this Policy from time to time and in our sole discretion. If we
materially change this Policy with respect to your personal information, we
will provide appropriate online notice to you and give you a choice with
respect to the change. When we make changes to this Policy, we will alert you
that changes have been made by indicating on the Policy the date it was last
updated. When you visit the Site, you are accepting the current version of this
Policy as posted on the Site at that time. We recommend that users revisit this
Policy on occasion to learn of any changes.
